1.            Contest runs August 3, 2010 and ends October 30, 2010.

2.            Terms and Conditions of Entry: NO PURCHASE NECESSARY. VOID WHERE PROHIBITED BY LAW. ALL FEDERAL, STATE AND LOCAL LAWS, RULES AND REGULATIONS APPLY. Prizes are non transferable and not negotiable.  Only one sponsor contest prize may be won per household during this contest.  Households who win sponsor contest prizes are eligible to win the grand prize.  This multi-station contest “This One’s For The Girls” ("Contest") is operated by Backyard Broadcasting South Dakota, LLC (“Company”), d/b/a as Stations KRRO-FM, KELO-FM, KELO-AM, KSQB-FM, KTWB-FM, KWSN-AM and KXQL-FM (“Stations”). THESE RULES WERE INITIALLY PUBLISHED ON 08/10/2010 AND REVISED ON 08/23/2010.

3.            Eligibility: Contest is open to South Dakota, Minnesota, Iowa and Nebraska residents 21 years of age and older at time of entry. You must have a valid street address in the state of South Dakota, Minnesota, Iowa or Nebraska (a P.O. Box address will not suffice). Employees or agents of the Company, STATIONS, contest sponsors, other radio Stations in the Sioux Falls, South Dakota area and each of their respective affiliates, subsidiaries, and parent companies and the immediate family members (i.e., spouses, parents, grandparents, children, grandchildren, and siblings) of each and persons domiciled with such persons are not eligible to participate.

4.            Prizes & Odds: Approximate value of grand prize package is $8,000.00.  Grand Prize package consists of but is not limited to: a two year lease on a 20XX Mazda 3 “i-Touring” sedan valued at $8,000.00 or $5,000.00 in cash from Billion Mazda (Billion may be pre-paying this 24 month lease for winner, however, winner (lessee) will have some obligations, which will include but not be limited to applicable taxes, license, and insurance.  Other prizes in “Contest” will be given away by random drawings during live broadcasts at sponsor locations.  One prize to be given away per sponsor location.  These prizes include but are not limited to: Forty large one topping pizza certificates from Domino’s Pizza valued at $500.00; $800.00 gift certificate from Sylvan Learning Center; $500.00 gift certificate from QDoba Mexican Grill; a complete canning package from Nyberg’s Ace valued at $500.00; $500.00 gift certificate from Tote-ally Gorgeous; $500.00 gift certificate from Forget Me Not Gift Boutique; Large Antiqued Mirror from John Adams Collection valued at $500.00;  $500.00 VIP party tab from The Vault; two 10-week body shaping programs from Ferrell’s Extreme Body Shaping valued at $778.00; a nutritional prize pack certificate from Complete Nutrition; $500.00 gift certificate from 8th & Railway merchants association; $500.00 gift certificate from Bella Boutique; $500.00 gift certificate from Royal Limousine; a 14 karat white gold diamond necklace and earrings set from Gunderson’s Jewelry valued at $650.00; a hand-knotted antique rug from Rug & Relic valued at $750.00; $500.00 gift certificate from Riddle’s Jewelry; $500.00 gift certificate from Splash City; $500.00 gift certificate from Inland Shoes; a $500.00 gift certificate from Elegant Xpressions; a Girls Night Out package from Washington Pavilion featuring ten (10) tickets to “Legally Blonde”; a $500.00 gift certificate from Carolan Rental; a $500.00 gift certificate from Dakota Entertainment; a $1,000.00 gift certificate from Comfort King; one year medium press tanning from Year Round Brown; a $1,000.00 gift certificate from Trademark Uniforms; a $500.00 gift certificate from Hagen Chiropractic; a $500.00 gift certificate from Park Ridge Galleria.  Prizes are not transferable. A cash payment of $5,000 may be offered by Billion Automotive in lieu of two year lease on Mazda 3 “i-Touring” sedan if winner chooses that option. All other Prizes cannot be substituted, altered or negotiated. 

5.            The odds of winning depend on the number of participants.  Winner is responsible for paying all applicable local, county, state and federal taxes on prizes.  IRS 1099 forms for all prizes won from Stations (where the aggregate value of all prizes is $600 or more) will be issued to contest winner. Winner must provide proper identification and social security card (to verify their social security number) to claim prizes.

6.            How to Enter/Contest Mechanics: August 5, 2010 through October 30th, 2010, contest can be entered at sponsor locations during “live action broadcasts though register-to-win forms during times of broadcasts.  A minimum of 100 semi-finalists will be drawn from live action broadcast events and sponsor locations during run of “Contest.”.  “Contest” can also be entered at Stations websites.  On-line entry deadline is 11:59 PM Tuesday October 26, 2010.  Maximum of (10) semi-finalists will be drawn from on-line entries.  All semi-finalist entries will be put into one qualifying pool of no more than 110 semi-finalists who must be present to win at grand prize contest ceremonies during a live broadcast on October 30, 2010 at Billion Mazda, 3401 West 41st Street, Sioux Falls, SD  57106.  Semi-finalists will be determined at the sole and absolute discretion of Stations’ management. Stations will make a reasonable attempt to notify semi-finalists by telephone and letter. Voicemail messages will be deemed received. Time of broadcast 1:00 PM until 3:00 PM. Registration from 1:45 PM until 2:45 PM. Prize ceremonies will take place October 30, 2010 starting at approximately 3:15 PM and all qualifiers must be present to win. Winner will be selected at this event.  Grand Prize will be awarded at prize award ceremony on Tuesday November 2nd, 2010 at Backyard Broadcasting 500 S Phillips Avenue Sioux Falls, South Dakota. Winner must be present at grand prize pickup ceremony with all proper identification to execute documents and claim prize.

a.            Each final qualifier receives a key and one key will open the prize box. The qualifier whose key opens the Prize box wins the grand prize.  Blank keys provided by Backyard Broadcasting.

b.            Should grand prize winner choose not to accept grand prize package, prize is forfeited. Under no circumstances will any cash prize substitutions (other than those specifically mentioned above) be offered. In the event of prize forfeiture, a random drawing will be held at the Company’s time and choosing to determine alternate contest winner following end of contest.  Remaining qualifiers in attendance at the October 30th event at Billion Mazda will be eligible for any such alternate winner random drawing.  Contest is deemed complete upon acceptance of grand prize package at time of prize pick-up and execution of all winner release forms at Stations’ offices at the designated day and time. The Winner accepts the prize package as valued and acknowledges that the package must be either accepted or declined in its entirety.  There will be no option to accept a portion of the prize package. Rejection of a single item in the prize package will be deemed to be rejection of the entire prize package. The Company will make a good faith effort to verify the values provided by the prize sponsors but is in no way responsible for any inaccuracies with respect to valuation. The winner may chose not to accept the prize package as their sole remedy for any alleged discrepancies in value.  The winner understands that by accepting the prize package they have expressly agreed to be responsible for any tax liability associated with the stated value of the prize package. 

7.            Limitation on Liability: By entering, all entrants release the Company and Stations and their respective affiliates, subsidiaries, parent companies, officers, directors, agents, promotional partners and employees from any and all liability with respect to or in any way arising from this Contest and/or acceptance or use of the prize.  The Company and Stations are not responsible for any incorrect or inaccurate information or for any technical or human error which may occur in the processing of entries, including any problems or technical malfunction of any telephone network or lines, computer on-line-systems, servers or providers, computer equipment, software, failure of email or players on account of technical problems or traffic congestion on the Internet or errors of the U.S. Postal service. The Company and Stations are not responsible for cheating or fraud by any entrants. If, for any reason, the Contest is not capable of operating as planned, including, without limitation, as a result of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the reasonable control of the Company and Stations, which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, the Company and Stations reserve the right at their sole discretion to cancel, terminate, modify or suspend the Contest and award prizes among eligible entries received.

8.            By participating, winners grant permission for their picture, voice and telephone call to be recorded, rebroadcast and posted on Backyard Broadcasting station websites and promotional and sales materials for use by the Stations.

9.            Contest Disputes: Stations’ Management shall be the sole arbiters of the Contest and in the interpretation of Contest rules. Their decisions shall be final. Entry into the Contest constitutes agreement by contestants to abide by these rules, as well as any other rules established by Stations. Stations reserve the right to change, alter, or modify these rules or to stop the Contest at any time with or without written notice.

ORGANIZATION CONTEST RULES

 The following are contest rules for the HyVeeBackyard Broadcasting High School Booster Organization Contest.  Visitors of all Sioux Falls Hy-Vee stores on Saturday mornings from 6 a.m to 11 a.m. between Sept 12th, 2009 and March 21st 2010.  Each visitor may cast one vote per visit for the booster club of their choice.  Prizes will be awarded based on a percentage of total votes received.  Minimum prize possibility is one hundred dollars, maximum prize possibility is $10,000.  A minimum of 1% of the total vote is required to qualify for any money awarded.  Contest open to all qualified booster organizations of South Dakota, Iowa, Minnesota and Nebraska. Standard KSQB-FM contest rules apply.  In the event any conflict exhists between the two sets of rules, these rules supercede.   No purchase necessary.  Taxes are the sole responsibility of the winner.  Backyard Broadcasting reserves the right to cancel or suspend this contest at anytime at their sole discretion.  Rules may be changed or amended at anytime and become effective upon announcement.  All decisions by Backyard Broadcasting regarding contest are final.  Complete CONTEST RULES AVAILABLE AT THE KELO AM STUDIOS, 500 South Phillips avenue, Sioux Falls, 57104 -- OR ONLINE AT www.keloam.com

GENERIC CONTEST RULES
 

These are the rules governing all contests aired on KELO-AM and on the keloam.com website. In the following rules, "KELO-AM" means Backyard Broadcasting of South Dakota, LLC, which owns KELO-AM radio:

1. No purchase is necessary to enter any KELO-AM contest.

2. Some KELO-AM contests will have specific rules that may amend these eligibility values, and these rules will be aired on KELO-AM during said contest. Only one winner per household is permitted per contest. Any prize awarded to an ineligible listener will be deemed null and void, and an alternate eligible winner may be named.

3. Anytime you call the KELO-AM studios you assume that your call will be broadcast or recorded and you grant us permission to broadcast the call or record if for later broadcast.

4. As a winner of a KELO-AM contest your voice, name and/or picture may be used for promotional, broadcast, or Internet purposes.

5. Prizes awarded are not redeemable for cash. No prize is transferable. No substitution for a prize will be made at the request of winner. KELO-AM reserves the right to substitute a prize of similar value.

6. All winners of all contests are responsible for all taxes on prize awarded. All winners of a prize valued at $600 or more will be required to complete the appropriate tax forms at the KELO-AM studios prior to claiming prize. All winners will be sent a 1099 MISC federal tax form if in one calendar year the prize value of all prizes won exceeds $600.

7. In the event the winner is subject to or the subject of any order or legal process issued by any governmental agency having jurisdiction over the affairs of the winner (i.e. garnishment, child support order, judgment, lien, and the like), KELO-AM delivery of the prize to the official representative of the governmental entity claiming a right to the prize shall be thus deemed as KELO-AM awarding the prize to the winner. KELO-AM shall be entitled to rely in good faith, upon any documents presented by the representative seeking to collect the prize in lieu of the winner. KELO-AM shall not be liable for any claim by any winner for damages incidental thereto.

8. All KELO-AM contests are open to all eligible U.S. residents 18 or over (unless otherwise specified). Contestants must possess a valid form of identification bearing the picture of the contestant acceptable to KELO-AM that will be presented to KELO-AM and accepted before the prize is awarded.

9. Winners will be expected to claim prize at the KELO-AM studios (unless otherwise noted), 500 South Philips Avenue, Sioux Falls, SD between 8am - 5pm, Monday through Friday (excluding holidays) within 30 days of being notified that they are winners, unless there is an expiration date on prize which will be specifically stated.

10. Employees of KELO-AM and Backyard Broadcasting South Dakota, LLC, their advertising agencies, affiliates, contest sponsors, employees and immediate families or significant others of each, and employees of all media of mass communication within a one hundred mile radius of the KELO-AM main studio are not eligible to win any contest. Immediate family includes the spouse, great-grandparents, grandparents, parents, brothers, sisters, children, grandchildren, and great-grandchildren of the employee and his/her spouse. This also includes individuals for whom the employee is current legal guardian.

11. All federal, state, and local laws and regulations apply. Contest is void were prohibited.

12. KELO-AM reserves the right to disqualify any winner if any contest rules are violated in any way.

13. KELO-AM and Backyard Broadcasting of South Dakota, LLC, assumes no liability for situations, repairs, or incidents arising from any aspect of any prize awarded in any contest. KELO-AM and Backyard Broadcasting of South Dakota, LLC, their advertising agencies, affiliates, contest sponsors, employees, and immediate families of each absolve themselves and shall be held harmless from any action or liability arising from any contest or prize awarded in any contest.

14. As a licensee of the FCC and a trustee of the public airwaves, KELO-AM reserves the right to interrupt and/or discontinue any contest or promotion (and not award the offered prize) at the discretion of KELO-AM management if world events, the national mood, or public safety so warrant.

15. KELO-AM reserves the right to amend the rules to any contest at any time. The judges decision is always final.

16. For any contest requiring phone entry you must use only the following number unless otherwise specified: (605) 336-1320. The person operating the telephone at KELO-AM has the final decision as to who is the winning caller.

17. KELO-AM shall have no responsibility for failure to win or claim any prize based on difficulties with telephone, facsimile, email, or Internet difficulties, or any circumstances in any contest.

18. The following are specifically related to E-contests promotions on keloam.com:

a. All appropriate information in required fields must be filled out or you will be disqualified.

b. To win a prize you must reside within the listening area of KELO-AM, as defined at the exclusive discretion of KELO-AM management.

c. Any problems with the Internet or email are not KELO-AM's responsibility.
